1. What This Policy Covers

This Policy explains how we handle information you give us through our marketing and inquiry channels. That includes our websites (easttowestfertility.com, etwfertility.com, and easttowestacupuncture.com), our online and social media lead forms — including forms submitted directly on Facebook and Instagram — and the emails, text messages, and direct messages we exchange with you before you become a patient.

This Policy does not cover your medical records. If you become a patient, the information created during your care is protected health information under HIPAA and is governed by our Notice of Privacy Practices, which is available in our office and provided to you at your first visit.

We want to be direct about the difference: information you submit through an advertisement, a website form, or a text message before you are a patient is generally not covered by HIPAA. It is protected by this Policy, by applicable state law, and by our own safeguards. We will not tell you it carries a federal protection that it does not.

2. Information We Collect

Information you provide. Your name, email address, phone number, city and postal code, age range, and the answers you give on our inquiry forms — which may include what you are hoping we can help with and whether you can attend in-person visits. Anything else you choose to tell us by text, email, phone, or direct message.

Information from advertising platforms. If you submit a form directly on Facebook or Instagram, Meta transmits to us the information you entered on that form. Meta's own handling of your data is governed by Meta's privacy policy, not this one.

Information collected automatically. When you visit our websites we may collect your IP address, device and browser type, the pages you view, the site that referred you, and similar technical information through cookies and comparable technologies.

Payments. Deposits and payments are handled by our payment processor. We do not receive or store your full card number.

3. How We Use Your Information

  • Contact you about the inquiry you submitted
  • Schedule, confirm, remind you about, and follow up on appointments
  • Answer your questions and provide support
  • Send you information about our services, programs, and offers
  • Measure how our advertising and website are performing
  • Improve our services and communications
  • Meet legal and professional obligations

We do not sell your personal information to data brokers or list resellers. We do not disclose the substance of your health-related answers to advertising platforms.

4. Text Messages and Automated Communications

Consent. When you provide your mobile number on one of our forms, you consent to receive text messages from us at that number about your inquiry, your appointments, and our services. Consent to receive marketing texts is never a condition of receiving care.

Automated and AI-assisted messaging. Some of our messages are sent using automated systems, and some of our text conversations are handled by an AI-powered scheduling assistant. If you ask whether you are speaking with a person, we will tell you truthfully and connect you with a member of our team. You can request a person at any time by replying HUMAN or calling 631-416-4940.

What the assistant will not do. It schedules appointments and answers general questions about our services. It does not give medical advice, interpret your labs or symptoms, or make clinical decisions. Nothing it tells you is a diagnosis or a treatment recommendation.

Frequency and cost. Message frequency varies. Message and data rates may apply.

Stopping messages. Reply STOP to any text to stop receiving them. Reply HELP for help. We honor opt-outs promptly and permanently.

Mobile numbers are not resold. Mobile opt-in information and consent are not shared with any third party for that third party's own marketing purposes.

Emergencies. Do not use text, email, or direct message for a medical emergency. Call 911, or call our office at 631-416-4940.

5. Who We Share Information With

We share information with service providers who perform work on our behalf and are contractually limited to using it for that purpose. These include our customer relationship and scheduling platform, our text messaging provider, our clinic records and patient portal system, our payment processor, our workflow and internal notification tools, and the marketing agencies that support our advertising.

We also disclose information when required by law, subpoena, or court order; when necessary to protect the rights, safety, or property of any person; and in connection with a sale or transfer of the practice.

Where a service provider handles protected health information as defined by HIPAA, we require a Business Associate Agreement.

6. Cookies, Analytics, and Advertising

Our websites use cookies, pixels, and similar technologies to operate the site, understand how visitors use it, and measure advertising performance. These may include tools provided by Meta and Google.

We want to be plain about what this means. These tools may record that a device visited a particular page on our site and may associate that visit with an advertising profile maintained by the platform. Under some state privacy laws this is considered "sharing" or a "sale" of personal information, even though we receive no money for it. We do not transmit your form answers, health details, or the reason for your appointment to advertising platforms.

Your choices:

  • Adjust or block cookies through your browser settings
  • Opt out of interest-based advertising at optout.aboutads.info and optout.networkadvertising.org
  • Turn on Global Privacy Control in a browser that supports it. We treat a Global Privacy Control signal as an opt-out of targeted advertising.
  • Contact us using the details in Section 10 and ask us to opt you out directly

7. Security and Retention

We use administrative, technical, and physical safeguards intended to protect your information from unauthorized access, use, alteration, and disclosure. No method of transmission or storage is completely secure and we cannot guarantee absolute security. Please do not send detailed medical information through unsecured email or social media direct messages.

We keep marketing and inquiry information for as long as we need it for the purposes described above and to meet our legal obligations, and then delete or de-identify it. Patient treatment records are retained for the period required by New York law and professional licensing rules.

8. Your Choices

You may:

  • Unsubscribe from marketing emails using the link in any message
  • Stop text messages by replying STOP
  • Ask us for access to, correction of, or deletion of the marketing and inquiry information we hold about you
  • Opt out of targeted advertising as described in Section 6
  • Withdraw consent you previously gave, going forward

Contact us using the details in Section 10. We will verify your identity before acting on a request. We will not treat you differently for exercising any of these choices.

Limits. We cannot delete information we are required by law to keep, including medical records, or information we need to complete a transaction, prevent fraud, or resolve a dispute. If you are or were a patient, requests about your medical record are handled under our Notice of Privacy Practices rather than this Policy.

If your state gives you additional rights over personal or consumer health information, contact us and we will honor them to the extent they apply.

9. Children and Third-Party Sites

Our services are intended for adults. We do not knowingly collect information from anyone under 18 through our websites or forms. If you believe a minor has given us information, contact us and we will delete it.

Our sites and messages may link to websites and platforms we do not control. Their privacy practices are their own.

10. Changes and Contact

We may update this Policy. The "Last Updated" date above reflects the most recent version, and material changes will be posted on this page.
